A BILL TO BE ENTITLED
 
AN ACT
  relating to the monitoring of emissions from certain facilities
  that emit air contaminants.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 382, Health and Safety
  Code, is amended by adding Section 382.0162 to read as follows:
         Sec. 382.0162.  MONITORING OF EMISSIONS FROM AGGREGATE OR
  CONCRETE FACILITIES. (a) This section applies only to a person who
  holds a permit issued under this chapter or is authorized to use a
  permit issued under this chapter relating to the operation of a
  facility:
               (1)  used for the production of aggregates, as defined
  by Section 28A.001, Water Code;
               (2)  used for concrete crushing; or
               (3)  that is a concrete plant that performs wet
  batching, dry batching, or central mixing.
         (b)  The commission by rule shall require a person described
  by Subsection (a) to conduct fence-line or property-line monitoring
  of emissions of air contaminants from the permitted facility.
         SECTION 2.  This Act takes effect September 1, 2025.
